The High Court of Cassation and Justice dismissed as inadmissible the reference question submitted by the Bucharest Court of Appeal regarding the application of the ten-year statute of limitations to the enforcement of alimony payments established through a property division ruling. The dispute centered on a civil procedure issue specifically whether the ten-year limitation period under Article 706(1), second sentence of the Civil Procedure Code, applies to the right to enforce compulsory execution of sums owed as alimony in the context of a partition decision. The court resolved the matter by rejecting the jurisdictional reference, thereby leaving the procedural question unresolved by the High Court and maintaining the status quo of the underlying civil litigation without establishing a binding interpretation on the limitation period for such enforcement actions.
