The High Court of Cassation and Justice dismissed as inadmissible a request for a preliminary ruling submitted by the Vâlcea Tribunal. The dispute concerned whether a service pension established under specific legislation for the Court of Auditors, which was subsequently reduced by a decision from a territorial pension office pursuant to government emergency orders and pension laws, and later annulled by a judicial decision, qualifies as a pension benefiting from the protection of a court judgment under Article 51(17) of the Law No. 94/1992, thereby exempting it from mandatory amount updates mandated by Article 51(10) of the same law. The legal basis for the dismissal relied on the procedural rules governing the admissibility of preliminary ruling requests under Article 521(3) of the Civil Procedure Code, meaning the issue regarding the pension's exemption status remains unresolved at this instance.
