The High Court of Cassation and Justice dismissed as inadmissible the request for a preliminary ruling filed by the Bucharest Court of Appeal regarding whether specific budgetary restrictions apply to salary seniority increases and promotions in the public sector. The dispute concerned the interpretation of Article 34(2) of Emergency Government Ordinance No. 114/2018, specifically whether its prohibitions on public spending extend to the payment of seniority grades and grade promotions under the public pay framework established by Framework Law No. 153/2017. Relying on the procedural standard of Article 521(3) of the Code of Civil Procedure, the Court found the submission from the lower court did not meet admissibility requirements, leaving the appellate court to resolve the conflict without a binding supreme court interpretation on the interplay between the fiscal emergency measures and the public salary legislation.
