The High Court of Cassation and Justice, sitting as the panel for resolving issues of law, upheld the reference submitted by the Court of Appeal of Pitești and issued a binding preliminary ruling that the salary increase mandated by the relevant framework legislation could be granted for the period preceding the issuance of the favorable opinion by the Ministry of Labor and Social Solidarity. The dispute arose from an interpretation conflict concerning the retroactive application of public sector salary adjustments, specifically challenging whether administrative clearance by the Ministry was a prerequisite for paying increases for prior periods. The decisive legal basis was the specific interpretation of Article 13, paragraph (1) of Chapter II of Annex No. VI and Article 8 of Chapter I, letter B of Annex No. I to Framework Law No. 153/2017, establishing that the statutory entitlement to the salary increase does not depend on the subsequent administrative ratification by the Ministry.
