The High Court of Cassation and Justice admitted a recourse in the interest of the law filed by the Board of Directors of the Court of Appeal, establishing a mandatory uniform legal interpretation that supersedes lower court practices. The dispute concerned the procedural requirements for withdrawing the professional license (attestation) of security personnel, specifically defining the triggering conditions for this administrative sanction under Romanian security services legislation. The court ruled that the withdrawal of the attestation for security guards or bodyguards must be ordered only after the individual has been referred to court for the commission of a service-related offense or an intentional crime. This determination is based on the interpretation of Article 61(1)(a) and (4) of Law No. 333/2003 regarding security services, in conjunction with Article 46(3)(a) of the Methodological Norms approved by Government Decision No. 301/2012, applying Article 517(4) of the Civil Procedure Code to ensure the binding nature of the decision for all courts.
