The High Court of Cassation and Justice rejected as inadmissible a reference for preliminary ruling filed by the Prahova County Court, leaving the lower court's procedural posture unchanged without resolving the merits. The dispute concerned whether contractual security guard personnel employed by the local Community Social Services Administration were entitled to a 15% hazardous conditions allowance based on their salary, questioning the applicability of specific occupational family regulations to this category of staff. The court determined the submission did not meet admissibility requirements, thereby refusing to interpret the interplay between the Framework Law on public salary, the Government Ordinance establishing hazardous work conditions for the "Administration" occupational family, and the Framework Regulation for the "Health and Social Assistance" occupational family.
