The High Court of Cassation and Justice dismissed as inadmissible the referral from the Alba Iulia Court of Appeal seeking a preliminary ruling, thereby leaving the lower court's question unresolved and the prior proceedings intact. The dispute concerned whether police officers who had established their domicile in the locality to which they were transferred for service still qualify for transport rights under art. 9(1)(j) of Government Decision No. 1198/2022 (in force at the time of the 03.01.2023 request) if they subsequently established their residence in another locality more than 301 km from both the workplace and their domicile. The Court based its decision on procedural inadmissibility, as the referral was lodged outside the permissible scope for a preliminary ruling under art. 521(3) of the Civil Procedure Code.
