The Supreme Court dismissed as inadmissible the request for a preliminary ruling submitted by the Court of Appeal of Timișoara, leaving the lower court to resolve the labor dispute without a binding interpretation from the higher instance. The underlying case involved a dispute over the calculation of legal interest on unpaid salary claims under Romania’s fiscal consolidation and tax evasion combat regulations, specifically challenging whether penal interest remains fully payable until effective settlement of the principal debt or if it must be limited to remuneratory interest after a judicial judgment is issued and during enforcement. The decisive legal basis for the inadmissibility, and the subject of the proposed clarification, concerned Article IX(5) of Emergency Government Ordinance No. 115/2023 regarding public expenditure, fiscal consolidation, and modifications to tax laws, with the procedural standard for admissibility governed by Article 521(3) of the Civil Procedure Code.
