The High Court of Cassation and Justice, sitting as the Full Court for the Settlement of Legal Issues, dismissed as inadmissible the reference for a preliminary ruling filed by the Court of Appeal of Constanța, thereby preventing a definitive interpretation on the disputed legal question and leaving the procedural fate of the underlying administrative-fiscal dispute to the referring court. The case concerned the interpretation of Article 417(3) of Emergency Government Ordinance No. 57/2019 (the Administrative Code), specifically whether public authorities are obligated to reimburse travel expenses and rent for public employees domiciled in a locality different from their workplace when service housing is not available. The court’s decision rests on the procedural requirements for admissibility of references under Article 521(3) of the Civil Procedure Code, which governs the submission of questions of law to the Full Court, rather than providing a substantive ruling on the reimbursement obligations under the Administrative Code.
