The High Court of Cassation and Justice (Înalta Curte de Casaţie şi Justiţie), sitting as a panel for the preliminary resolution of legal questions, dismissed as inadmissible the referral from the Oradea Court of Appeal (Civil Section I) in case no. 2620/111/2023, which sought a preliminary ruling on whether Article 192(1) of Law No. 263/2010 on the unified public pension system requires mutual recognition of contribution periods between the public pension system and non-integrated special social insurance systems for the purpose of establishing entitlement to partial early retirement pension. The referral was rejected as inadmissible, so the procedural decision—rather than a substantive interpretation of the pension law—prevails, and the ruling is binding under Article 521(3) of the Civil Procedure Code. The underlying dispute involves the interpretation of pension legislation concerning the cross-system recognition of contribution periods for early retirement eligibility.
