The High Court of Cassation and Justice, through the Panel for Adjudicating Recourse in the Interest of Law, admitted a recourse filed by the leadership of an appellate court and established that the 25% increase to the gross base salary/grade allowance for the "Justice" occupational family, as interpreted by the Court’s earlier decision resolving legal issues, precludes any further cumulative 25% increase of the sectoral reference value under the same legal basis. The dispute concerned the interpretation of salary structures for public personnel funded from public funds, specifically whether the statutory 25% premium could be applied cumulatively to an already adjusted base. The decisive legal basis relied on Article 38(3)(a) of Law No. 153/2017 regarding the pay system for public-funded staff, in the interpretation provided by the Court’s Decision No. 43 of September 16, 2024, and the mandatory effect of Article 517(4) of the Civil Procedure Code, which mandates the uniform application of this legal interpretation to exclude double-counting of the salary increment.
