Delegated anticorruption investigators' competence limited to enumerated corruption offenses
Legislator summary
AI generatedThe High Court of Cassation and Justice admitted the appeal in the interest of the law filed by the managing board of the Alba Iulia Court of Appeal and established, as binding pursuant to Article 474(4) of the Criminal Procedure Code, that judicial police officers of the National Anticorruption Directorate are competent to perform, by delegation and under the conditions provided by law, criminal investigation acts ordered by the competent prosecutor exclusively in cases concerning offenses listed in Article 1(2) of Government Emergency Ordinance No. 120/2005. The dispute concerned the scope of delegated investigative competence of these officers, and the Court resolved the divergent practice by ruling that such delegation is limited to corruption-related offenses expressly enumerated in that provision, not extended to other offenses.
