Maintenance of Pretrial Detention Following Conviction for Aggravated Theft
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed the appeals filed by the defendants, thereby upholding the Court of Appeal's decision to keep them in preventive detention. The case concerned a challenge against the appellate court's order to maintain the custodial status of three individuals convicted of aggravated theft and complicity in aggravated theft, where the lower courts had imposed prison sentences of six years for two defendants and five years plus 227 days for the third. Relying on Article 385(15)(b) of the Code of Criminal Procedure, the supreme court determined that the legal grounds for pre-trial detention remained valid and dismissed the motions for release. As a result, the defendants were ordered to bear judicial costs, with a portion allocated to cover the official defense attorney's fees advanced by the Ministry of Justice, rendering the decision final.
