The High Court of Cassation and Justice dismissed as inadmissible the reference filed by a civil court for the resolution of a legal issue regarding public employees under the Ministry of Environment, Water, and Forests who received salaries below the maximum levels specified in Annex to Order No. 1006/2021, thereby leaving the lower court to determine whether these individuals were entitled to the difference between their effective pay and the statutory maximums for similar positions. The dispute concerned a reference for uniform interpretation of the law under Article 521(3) of the Code of Civil Procedure, specifically focusing on the legal rights of civil servants to claim salary top-ups based on ministerial salary schedules, with the Supreme Court ruling that the preliminary reference mechanism was not properly invoked or justified in this context.
