Magistrate pension recalculation under Law 303/2004 vs. 303/2022, statute of limitations, and inflation adjustments
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed as inadmissible the referral submitted by the Bucharest Tribunal for a preliminary ruling on a question of law, leaving the lower court's jurisdiction to resolve the individual dispute regarding a former magistrate’s service pension. The case concerned the method for updating the pension under either Article 85 of Law No. 303/2004 or Article 213(2) of Law No. 303/2022, the applicability of statute of limitations to claim the difference between the pensioner’s benefits and those of active judges following salary increases, and the mandatory application of inflation indices and penal legal interest to the resulting arrearages. The decisive procedural ground was the inadmissibility of the referral pursuant to Article 521(3) of the Code of Civil Procedure, thereby preventing a binding interpretative decision on the competing pension legislation and limitation defenses.
