The High Court of Cassation and Justice dismissed as inadmissible the request for a preliminary ruling submitted by the Cluj Court of Appeal, leaving the lower court’s procedural handling of the dispute to continue without Supreme Court intervention. The case involved a labor dispute concerning the interpretation of statutory leave entitlements for teaching staff, specifically whether the right to monetary compensation for unused annual leave applies in the context of "pre-transfer" (pretransfer) as defined in education mobility regulations. The decisive legal issue centered on the interplay between Article 146(3) of the Labor Code, Article 11(2) of the Methodological Norms for educational leave, Article 252(5) of the National Education Law, and Article 4(1)(j) of the Framework Methodology for teacher mobility for the 2022-2023 school year, with the Supreme Court declining to provide a binding interpretation due to the admissibility defects in the referral.
