The High Court of Cassation and Justice rejected as inadmissible the referral submitted by the Bâcau Court of Appeal, effectively upholding the lower court's discretion and leaving the pending civil dispute regarding salary indexation unresolved by this abstract ruling. The case involved a dispute over whether the update of a military or police officer's base pay, governed by the Framework Law on Public Sector Salaries and specific government emergency ordinances, had to be applied retroactively from January 1, 2023, in the specific amounts stipulated by a subsequent Government Decision intended for the security sector personnel. The decisive procedural basis for the dismissal was Article 521(3) of the Civil Procedure Code, which governs the admissibility of referrals to resolve questions of law, rendering the mandatory decision final without providing the substantive legal clarification requested regarding the application of legislative modifications to public sector wages.
