The High Court of Cassation and Justice admitted the appeal in the interest of the law filed by the Presiding Council of the Alba Iulia Court of Appeal, establishing a binding legal interpretation that applies to cases involving the alienation of social parts. The dispute centered on the temporal applicability of the prohibition against transferring ownership shares in companies created under the government stimulus program for small and medium-sized enterprises. The Court ruled that the restrictive provisions of Article 61 of Emergency Government Ordinance No. 10/2017, as amended and completed by Law No. 218/2020, apply to any alienation of social parts occurring after the entry into force of the relevant article, regardless of whether the original financing agreement was concluded before the amendment.
