Recourse in the interest of the law admitted to establish mandatory rule: challenges to crime victim compensation decisions heard by two-judge panel under non-contentious appeal procedures
Legislator summary
AI generatedThe High Court of Cassation and Justice admitted a recourse in the interest of the law filed by the Presidium of the Court of Appeal of Brașov, establishing a mandatory unitary interpretation that such appeals must be heard by a panel of two judges following the specific rules for appeals in non-contentious proceedings. The case arose from a dispute regarding the proper procedural composition and application of law for challenging decisions issued by the Commission for Granting Financial Compensation to Crime Victims, constituted within the tribunals. The decisive legal basis is Article 31(6) of Law No. 211/2004, as amended by Law No. 272/2024, which governs the judicial review of compensation claims or advances for crime victims, interpreted in conjunction with Article 517(4) of the Code of Civil Procedure to define the obligatory nature of this procedural ruling.
