The High Court of Cassation and Justice, in a decision binding upon publication in the Official Gazette, resolved a preliminary question of law submitted by the Bucharest Court of Appeal, holding that the satisfaction of sexual gratification is not a requisite element for the typicity of the offense. The dispute concerned whether the specific intent (scopus) to obtain sexual satisfaction must be proven for the crime of sexual aggression against a minor to be established. The court decided in favor of the interpretation that such a subjective condition is unnecessary for conviction under the cited provisions. The decisive legal basis is Article 219(1), (12), and (3)(a) and (b) of the Criminal Code, regarding sexual aggression against a minor, interpreted in conjunction with Article 477(3) of the Code of Criminal Procedure, which governs the binding nature of the resolution on matters of law.
