The Supreme Court of Romania dismissed as inadmissible the referral to the Grand Chamber for the resolution of legal issues, meaning the requesting appellate court’s submission was rejected and the dispute remains pending at the instance court. The case involved a procedural challenge regarding whether employees of the Toxicology and Serology Laboratory within a Forensic Medicine Service were legally entitled to special working conditions under specific interpretations of labor and medical legislation. The decisive legal basis for the dismissal was the inadmissibility of the referral under the civil procedure code, concerning the interpretation of Law No. 104/2003 on the handling of human corpses and organ donation, Government Ordinance No. 1/2000 on forensic medicine institutions, and the precedent set by the Supreme Court’s Grand Chamber Decision No. 24 of October 14, 2019.
