ÎN NUMELE LEGII

DECIDE:

Respinge, ca inadmisibilă, sesizarea formulată de Tribunalul Suceava – Secţia de contencios administrativ şi fiscal, în dosarul nr. 2846/86/2023, în vederea pronunţării unei hotărâri prealabile cu privire la următoarea chestiune de drept:

Dacă, în ceea ce-i priveşte pe funcţionarii publici de sex feminin, dreptul la pensie poate fi solicitat simultan cu opţiunea pentru continuarea raportului de serviciu până la împlinirea vârstei de pensionare prevăzute de lege pentru bărbaţi, respectiv până la împlinirea vârstei de 65 de ani.

Obligatorie, potrivit dispoziţiilor art. 521 alin. (3) din Codul de procedură civilă.

Pronunţată în şedinţă publică astăzi, 19 mai 2025.
