Admissibility of referrals on whether public food allowances are subject to salary caps under Framework Law 153/2017
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed as inadmissible the consolidated referrals from the Suceava and Prahova Courts of Appeal, meaning no preliminary ruling on the legal questions was issued and the underlying cases remain with the referring tribunals. The disputes concerned whether the food allowance (indemnizația de hrană) paid to public officials and specialized auxiliary court staff is subject to the salary limit caps established by Article 25 and/or Article 11(4) of Framework Law No. 153/2017 on public sector remuneration, specifically questioning if these limits applied to the allowance provisions under Article 18(1) of the same law as in force on April 24, 2023. The decisive procedural basis was the inadmissibility of the referral under the civil procedure rules governing unified case law (referend prealabile), resulting in the rejection of the request to unify legal interpretation regarding the classification and cap limits of specific public sector allowances.
