The High Court of Cassation and Justice, sitting as the Full Court for Resolving Matters of Law, dismissed as inadmissible the reference for prior ruling submitted by the Alba Iulia Court of Appeal, thereby leaving the matter to be resolved without a definitive supreme court interpretation on the specific legal question. The dispute concerned whether a public health laboratory microbiologist performing duties eligible for a standard 15–25% wage bonus and separate duties for HIV/AIDS care eligible for a 55–85% bonus is entitled to the higher bonus for the entire work schedule or if the bonuses must be prorated proportionally to the time worked in those specific conditions. The court’s decision was based on procedural grounds, citing Article 521(3) of the Code of Civil Procedure, which renders the decision binding on the referring court and prevents further referral on the same issue, effectively denying the request for a uniform interpretation of Article 8 of the Framework Regulation established by Government Decision No. 153/2018 regarding the application of wage bonuses in the public sector.
