The High Court of Cassation and Justice dismissed as inadmissible the reference for a preliminary ruling submitted by the Bucharest Court of Appeal, meaning no uniform legal interpretation was issued and the lower court's proceedings remain unaffected by this high court order. The dispute concerned whether employees of the National Administration "Romanian Waters" were entitled to a 15% consignment allowance after January 1, 2023, specifically questioning if the right persisted regardless of whether the specific event requiring home consignment actually occurred. The legal issue centered on the interpretation of Article 10(d) of Annex No. VII to Framework Law No. 153/2017 regarding public sector salaries, where the admissibility check of the reference was the decisive factor leading to the dismissal without resolving the substantive salary rights question.
