The High Court of Cassation and Justice rejected as inadmissible the reference for preliminary interpretation submitted by the Oradea Court of Appeal in a fiscal administrative dispute, leaving the lower court's position unresolved at this instance. The dispute concerned the cessation of rights to a monthly rent or mortgage compensation allowance for a public official with special status who, after the benefit was initially granted, married a spouse who had previously alienated a housing unit within the legislative look-back period. The legal issue centered on the interpretation of the conditions for granting such compensation and the specific provisions regarding the alienation of housing units by spouses, referencing specific norms from the Ministry of Justice Order on housing benefits for penitentiary police.
