Scope of “schooling fee” under public salary framework law: inclusion of childcare costs and mandatory cost breakdown for reimbursement
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed as inadmissible the preliminary reference question submitted by the Bucharest Tribunal, thereby leaving the lower court to resolve the matter without a binding unification ruling from the supreme court. The dispute centered on the interpretation of the "schooling fee" provided for under Article 4(1)(f) of the annex to the Framework Law on the salary system for public-funded staff, specifically questioning whether this fee for antepreschool and preschool education includes only educational costs or also supervision and care, and whether documents issued by kindergartens must itemize these distinct costs for reimbursement purposes. The decision hinges on the procedural admissibility requirements under Article 521(3) of the Code of Civil Procedure, which governs the conditions for posing preliminary questions to the complete panel for the resolution of legal issues.
