The High Court of Cassation and Justice, sitting as the Full Court for the Resolution of Legal Issues, dismissed as inadmissible a referral for a preliminary ruling submitted by the Constanța Tribunal regarding a labor dispute concerning the payment of a specific salary bonus. The case involved whether a salary supplement regulated by Article 21(3) of the Framework Law No. 153/2017 could be granted to an individual whose employment or service relationship had already terminated, a question raised in the context of public sector remuneration and military personnel salaries. The court rejected the request to resolve this conflict of law, effectively leaving the lower court’s procedural posture unchanged and denying the establishment of a binding precedent on the compatibility of the bonus with the termination of the labor relationship under the cited emergency decree and ministerial order.
