The High Court of Cassation and Justice, acting in its full panel for resolving legal issues, dismissed as inadmissible the preliminary questions of law submitted by the Galați and Prahova Courts of Appeal, leaving the lower courts to resolve the matters without a binding uniform interpretation. The disputes concerned whether specific categories of workers—namely, staff of medical-social units operating without a license or accreditation certificate, and personal assistants for individuals with severe disabilities—were entitled to a risk allowance for the period of March 15 to May 15, 2020, under Article 7(5) of Emergency Government Ordinance No. 43/2020, which provided for support measures funded by European sources during the state of emergency related to the coronavirus pandemic. The decisive procedural basis for the dismissal was the inadmissibility of the referrals, rather than a substantive ruling on the eligibility criteria or the application of the cited emergency ordinance provisions.
