The High Court of Cassation and Justice dismissed as inadmissible the referral submitted by the Sibiu Court of Appeal regarding the unification of case law. The underlying dispute concerned the statutory grounds for revocation from office for a national anticorruption prosecutor, specifically whether the limited grounds enumerated in Article 10(61) of Emergency Government Ordinance No. 43/2002 (referring to Article 2713 of Law No. 360/2002 on the police statute) preclude the invocation of other motives, such as disciplinary reasons, and whether such grounds require prior definitive solutions. The Court found the referral non-compliant with the admissibility requirements for uniting case law under Article 521(3) of the Civil Procedure Code, thereby leaving the lower court's pending interpretation issue unresolved at the Supreme Court level.
