The High Court of Cassation and Justice dismissed as inadmissible the request for a preliminary ruling filed by the Tribunal of Dâmbovița, thereby leaving the lower court's proceedings without a binding interpretation from the Supreme Court on the specific legal question raised. The dispute involved a civil matter concerning the interpretation of salary ceiling limits for public sector employees under fiscal-budgetary measures, specifically whether the 2022 total salary fund limit was based on the effective amount paid at the end of the fiscal year or the nominal value established by the framework law on public sector salaries and its annexes. The decisive legal basis for the dismissal was Article 521(3) of the Code of Civil Procedure, which governs the admissibility requirements and procedural obligations for referring questions of law to the complete judicial panel for the resolution of legal issues.
