Conflict between Labor Code severance provisions and special public sector salary ordinances for the 2016–2019 period
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed as inadmissible the request for a preliminary ruling on a question of law filed by the Alba Iulia Court of Appeal, leaving the lower court to resolve the matter without a binding supreme court interpretation. The dispute concerned whether Article 123(3) of the Labor Code, which generally governs the calculation of severance pay or compensation for employees, applies to former employees whose employment contracts ceased during the 2016–2019 period, given that their remuneration was specifically regulated by a series of emergency government ordinances (OG 57/2015, OG 99/2016, OG 90/2017, and OG 114/2018) regarding public sector salaries and fiscal measures. The decisive legal basis involves the potential conflict or hierarchy between the general provisions of the Labor Code and the special normative acts regulating public sector compensation for that specific timeframe, with the Court ruling on the admissibility of the judicial reference under Article 521(3) of the Code of Civil Procedure.
