The High Court of Cassation and Justice dismissed as inadmissible the reference to a preliminary question submitted by the Bucharest Court of Appeal, meaning no preliminary ruling was issued and the lower court's proceedings continue without a binding interpretive answer from the supreme court. The dispute concerned whether a public autonomous media organization, subject to parliamentary control and organized by organic law, was prohibited from issuing meal vouchers during 2022 under the fiscal and budgetary measures established by Government Emergency Ordinance No. 130/2021. The legal issue centered on the interpretation and application of Article III(1) of that ordinance, specifically regarding the restriction or allowance of certain employee benefits in the public sector context.
