Reduced retirement age for dancers: conflict between specific occupational provisions and general 15-year age reduction cap in the Public Pension Law
Legislator summary
AI generatedThe High Court of Cassation and Justice (ICCJ) dismissed as inadmissible the referral for a preliminary ruling submitted by the Alba Iulia Court of Appeal, thereby leaving the lower court to resolve the specific civil dispute without a mandatory binding interpretation from the superior court. The case centered on whether dancers with at least 20 years of insurance record in the specific occupational categories defined by the law could claim a reduced retirement age of 40 years for women and 45 years for men, or whether their reduced age was capped at a 15-year reduction from the standard retirement age. The decisive legal issue involved the interpretation and interplay between Article 56(2)(b) and Article 56(1)(b) of Law No. 263/2010 on the public pension system, specifically regarding the calculation of reduced retirement ages for special occupations.
