Inadmissibility of preliminary ruling on re-entry into force of auxiliary staff statute and validity of suspended retirement allowance
Legislator summary
AI generatedThe High Court of Cassation and Justice rejected as inadmissible the request for a preliminary ruling submitted by the Tribunal of Vâlcea, meaning no binding interpretation of the law was issued and the underlying dispute remains pending at the lower instance level. The case concerned a civil proceeding involving labor and social security conflicts, specifically whether the declaration of unconstitutionality of the 2024 Statute of Court Clerks and subsequent re-entry into force of the 2004 Statute for Specialized Auxiliary Personnel reinstated the right to the retirement allowance under Article 69(1) of the latter law, or if the previously imposed suspensions of that right remained applicable, while also raising issues of potential violations of the right to property under the First Additional Protocol to the European Convention on Human Rights and alleged discrimination between retired auxiliary staff and the heirs of deceased staff. The court's admissibility analysis focused on the procedural requirements for initiating a conflict of law under Article 521(3) of the Civil Procedure Code, determining that the referenced legal questions did not meet the statutory criteria for a mandatory preliminary ruling by the supreme court.
