The High Court of Cassation and Justice of Romania dismissed as inadmissible two referral applications from lower courts seeking clarification on labor law issues for magistrates, thereby denying the requesting tribunals' requests for unified legal interpretation. The first dispute concerned whether judges and judicial assistants in the "Justice" occupational family could claim compensation for overtime work based on the average salary from the last three years prior to filing suit, invoking the Labor Code and Civil Code; the second dispute addressed whether a "permanent inactivity" period, where a magistrate remains at the employer's disposal without performing duties, constitutes overtime work under EU Directive 2003/88/EC and associated Romanian legislation. The Court ordered that the referrals are inadmissible, leaving the matters for resolution by the respective courts without the requested unification of judicial practice, pursuant to Article 521(3) of the Code of Civil Procedure.
