Eligibility of family medicine practitioners for post-mortem COVID-19 pensions and pension base calculation under Law 56/2020
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed as inadmissible the referral by the Craiova Court of Appeal for a preliminary ruling, meaning no final determination on the merits was issued and the lower court’s referral procedure is terminated without a substantive decision on the legal questions. The dispute concerned the interpretation of Law No. 56/2020, specifically whether general practitioners in private family medicine cabinets are included in the category of medical personnel eligible for post-mortem pensions for COVID-19 victims, and, if so, how to calculate the pension base when the practitioner lacks a standard base salary or position allowance under Article 2(1)(a) and Article 4(1)(b) of the Law. The court’s decisive legal basis was the procedural inadmissibility of the referral under Article 521(3) of the Civil Procedure Code, which precluded the substantive application of the provisions regarding the recognition of merits for medical staff during the pandemic.
