The High Court of Cassation and Justice dismissed as inadmissible the preliminary reference submitted by the Mehedinți Tribunal, thereby leaving the lower court to resolve the dispute without a binding legal interpretation from the supreme court. The case concerned a civil employment dispute where special-status public officials serving as judicial police officers and designated judicial investigation bodies sought confirmation that they were entitled to a 25% risk and neuropsychic overexertion allowance, based on a challenge to the interpretation of their salary components. The decisive legal analysis involved the interplay between Article 5 of Annex No. V and Article 13 of Annex No. VI of the Framework Law No. 153/2017, combined with the specific provisions of Order No. S/7/2018 issued by the Ministry of Internal Affairs.
