The High Court of Cassation and Justice dismissed as inadmissible the preliminary reference request filed by the Bucharest Court of Appeal regarding whether a 50% salary bonus for particularly dangerous working conditions is due to specialist doctors employed by a general directorate for social assistance and child protection. The dispute centered on whether the bonus applies even when the specific workplace was not effectively expertized under the framework regulation because the position was vacant during the expertization process. The Court declined to address the substantive labor law issue concerning the applicability of Article 14 of Annex II to Framework Law No. 153/2017 and the implementation of Government Decision No. 153/2018, thereby leaving the procedural question unresolved at this instance and allowing the lower court to determine the admissibility of the reference or its substantive merits.
