The High Court of Cassation and Justice dismissed as inadmissible the reference for a preliminary ruling made by the Bucharest Tribunal, meaning the lower court's request for clarification was rejected without a substantive decision on the legal question. The dispute concerned the interpretation of Law no. 223/2015 regarding state military pensions, specifically whether contribution-based bonuses of 3%, 6%, and 9% are included within the pension cap of 85% of the military wage or added on top of that limit. The decision rests on the procedural grounds of inadmissibility under Article 521(3) of the Civil Procedure Code, with the ruling being mandatory pursuant to the same provision.
