The High Court of Cassation and Justice dismissed as inadmissible the referral from the Dolj Tribunal (labor and social insurance section) seeking a preliminary ruling on whether the period 01.04.2001–20.08.2021 was classified *ope legis* as special working conditions under art. I(1) of Law No. 197/2021 amending Law No. 263/2010, regardless of the employer’s prior classification; the dismissal leaves the referring court’s underlying case (Dosar nr. 6.264/63/2023) unaffected, and the decision is binding under art. 521(3) of the Civil Procedure Code. The dispute concerned the interpretation of pension-law provisions on special working conditions after the 2021 amendment. The court found the referral inadmissible because the question did not meet the statutory conditions for a preliminary ruling under the relevant procedural rules.
