The High Court of Cassation and Justice, in its plenary bench for resolving questions of law, admitted a referral from the Court of Appeal and issued a binding decision establishing that leave bonuses for transferred public sector employees must be calculated based on the salary at the new unit of assignment, corresponding to the calendar months in which the leave is taken. The case arose from a dispute regarding the correct legal interpretation for computing leave entitlements for staff transferred between public administration, autonomous regions with special characteristics, or budgetary units, requiring a uniform application of national labor regulations. The decisive legal basis comprises Articles 7(1) and (2) and Article 14(3) of Government Decision No. 250/1992 concerning leave and other types of leave for employees in the public sector, interpreted in accordance with Article 521(3) of the Code of Civil Procedure, which renders the decision mandatory for all courts.
