Admissibility of referral on whether senior legal advisor and expert positions constitute similar functions under public sector salary law
Legislator summary
AI generatedThe High Court of Cassation and Justice (ICCJ) dismissed the referral of a question of law as inadmissible, meaning the lower court's pending procedure remains unaffected by this decision, and no substantive ruling on the merits was issued. The dispute originated from a reference by the Oradea Court of Appeal in an administrative and fiscal case concerning the interpretation of public sector salary regulations, specifically challenging whether the position of "senior legal advisor" and the position of "expert" at the same grade are considered similar functions under the applicable legal framework. The decisive legal basis for the dismissal was the procedural inadmissibility of the referral, evaluated against the requirements of Article 521(3) of the Civil Procedure Code, which governs the binding nature of such pre-judicial decisions, resulting in no clarification of Article 39 of Law 153/2017 or related government decisions.
