The High Court of Cassation and Justice dismissed as inadmissible the reference for a preliminary ruling filed by the Bucharest Court of Appeal, leaving the procedural status of the underlying case unchanged. The dispute concerned the interpretation of an emergency decree providing a risk allowance for healthcare workers, specifically whether the phrase "patients diagnosed with COVID-19" requires a confirmed PCR test result or also includes presumptive diagnoses recorded in emergency service intervention forms. The case involved the application of the Emergency Governmental Ordinance No. 43/2020, as amended by Law No. 82/2020, and Article 521(3) of the Civil Procedure Code, which governs the mandatory nature of such preliminary rulings.
