The Supreme Court of Romania (Inalt a Curte de Casatie si Justitie) dismissed as inadmissible the consolidated referrals submitted by the Timisoara Court of Appeal, leaving the lower instances to proceed without a binding preliminary ruling on the applicable compensation regime for customs personnel. The dispute centered on whether work performed by custom officers on weekly rest days or public holidays is compensated under the specific statutory framework for customs staff (Emergency Order No. 10/2004), the general Labor Code (Law No. 53/2003), or the public sector salary framework (Law No. 153/2017). The Court’s decision rests solely on procedural grounds regarding the admissibility of the preliminary reference under Article 521(3) of the Code of Civil Procedure, thereby resolving the jurisdictional threshold without addressing the substantive conflict of laws between the special customs status legislation, the Labor Code, and the public sector pay regulation.
