The High Court of Cassation and Justice, acting through the Panel for Resolving Questions of Law, issued a binding preliminary ruling in favor of a uniform legal interpretation, determining that the term "salary rights" in Article IV of Emergency Government Ordinance No. 128/2023 refers exclusively to the "base salary" as defined in Article 7(a) of the Framework Law No. 153/2017. This decision resolved a conflict of law submitted by the Arad Court of Appeal regarding the interpretation of public-sector salary measures, specifically clarifying the scope of financial entitlements under the 2023 pay raise ordinance for budget-funded employees. The decisive legal basis established is that the "salary rights" provision in OUG 128/2023 is strictly limited to the base salary component under Law No. 153/2017, excluding other allowances or bonuses, thereby standardizing the application of these norms across all pending cases.
