The High Court of Cassation and Justice dismissed as inadmissible the referral from the Bucharest Court of Appeal seeking a preliminary ruling, so no substantive decision was issued and the underlying case remains pending. The dispute concerned whether the base salary (solda de funcție) of a specialist officer in the military prosecutor's section of the Prosecutor's Office attached to the High Court should be calculated using the sectoral reference value of 484.18 lei from the "Justice" budget occupational family, or under the rules of the "Defense, public order, and national security" family. The court based its dismissal on procedural inadmissibility under the relevant provisions of the Code of Civil Procedure (art. 521 alin. 3), meaning the referral did not meet the statutory conditions for a preliminary ruling on questions of law.
