The High Court of Cassation and Justice dismissed as inadmissible the three conjoined preliminary references submitted by lower civil courts, thereby leaving the procedural status of the underlying litigation open for resolution by the referring tribunals. The dispute concerned the qualification of the seniority bonus provided under Article 22 of Law No. 153/2017 as a component of the gross monthly salary for public sector employees and whether this classification triggers the application of the salary cap restrictions imposed by Article I(5) of Emergency Ordinance No. 168/2022 on fiscal and budgetary measures. The decisive legal basis involved the interplay between the public salary framework Law No. 153/2017 and the temporary fiscal constraints established by Emergency Ordinance No. 168/2022, with the Supreme Court determining that the questions referred did not meet the admissibility requirements for a binding prior ruling under Article 521(3) of the Code of Civil Procedure.
