The High Court of Cassation and Justice, acting as the body for resolving legal issues, issued a binding interpretation in favor of the referring tribunal's query, establishing that periods spent "at disposal" are recognized as service under special conditions for police officers who were reinstated to duty and had previously served in such special conditions. The case arose from a civil dispute concerning the calculation of military state pensions for police personnel, specifically challenging whether time spent at administrative disposal should count toward pension eligibility based on special working conditions. The court grounded its decision in Article 2729 of Law No. 360/2002 (Police Statute), read in conjunction with Article 11 of Law No. 223/2015 (Military State Pensions) and Government Decision No. 1,822/2004 regarding special working conditions, thereby clarifying the cumulative nature of special condition service across different employment statuses.
