The High Court of Cassation and Justice (ICCJ) ordered the annulment of the appellant’s complaint for failure to pay the judicial stamp tax, thereby ruling in favor of the opposing party and rendering the decision final. The dispute arose from a procedural request filed under Article 522 of the Civil Procedure Code, wherein the applicant sought to compel the drafting of a judgment previously pronounced in a lower court case, alleging that the delay violated the right to a fair trial under Article 6 of the European Convention on Human Rights. The decisive legal basis for the outcome was Article 197 of the Civil Procedure Code, which mandates the annulment of a legal remedy if the required stamp duty is not attached to the request; despite being formally cited on September 25, 2024, to pay the 20 RON tax for the appeal, the applicant failed to provide proof of payment by the hearing date of October 3, 2024.

Şedinţa publică din data de 3 octombrie 2024

Asupra contestaţiei de faţă;
